Leasing

When the price of the boat is billable, with VAT exposed, it is advisable to opt for Leasing, which follows the asset and is transferable to third parties, unless approved by the bank. In this case, the bank that distributes the yacht is the actual owner, and the user may be a natural or legal person (eg. a company). The transfer of the leasing contract by a legal person is for consideration, so the excess between the residual debt and the purchase price must be invoiced. In the transfer of the leasing contract stipulated before November 5, 2020, in which the user is a natural person, it is convenient for both parties to transfer the leasing contract. This is because the VAT applied will be facilitated thus avoiding early repayment, since the latter would be subject to VAT at 22%.

Financing

Financing is ad personam, therefore it follows the person who requests it – natural or legal person – and cannot be transferred to third parties. At the time of sale of the boat, the existing loan will have to be paid off and the buyer can request a new one.
